In the United States, cannabis has been a hot topic, with huge amounts of changes in laws and regulations. With a republican presidential candidate being announced in 2016, it was unlikely that we’d see any changes to the federal regulations involving cannabis, but there have been quite a few changes to individual state regulations during this period. That being said, with Canada just recently legalizing cannabis on a federal level, I think the United States could be next!

In Which U.S. States is Cannabis Legal to Use and Buy – Recreational vs. Medicinal:
As mentioned, previously the only movement recently has been on the state level rather than the federal level. This means that different states will have different laws pertaining to cannabis similar to certain areas in Australia. Along with this, some states have legalized cannabis for medicinal use and recreational use, other states have medicinal and not recreational, and other states still have both as illegal. Below we’ve broken down each state and their current cannabis regulation.
Medicinal and Recreational Cannabis Is Legal:
- Alaska
- California
- Colorado
- Illinois
- Maine
- Michigan
- Massachusetts
- Nevada
- Oregon
- Vermont
- Guam
- Washington
- Washington D.C (District of Columbia)
Just Medicinal Cannabis is Legal:
- Arizona
- Arkansas
- Connecticut – Recreational is decriminalized
- Delaware – Recreational is decriminalized
- Florida
- Hawaii – Recreational is decriminalized
- Louisiana
- Maryland
- Minnesota – Recreational is decriminalized
- Missouri – Recreational is decriminalized
- Montana
- New Mexico – Recreational is decriminalized
- New Hampshire – Recreational is decriminalized
- New Jersey
- New York – Recreational is decriminalized
- North Dakota – Recreational is decriminalized
- Ohio – Recreational is decriminalized
- Oklahoma
- Pennsylvania
- Rhode Island – Recreational is decriminalized
- Utah
- West Virginia
Furthermore, laws do still differ from state to state on the physical amount you can have, the form it is in, and your purpose of using it (recreational vs. medicinal). Along with this, there are also rules and regulations about growing involving the number of plants you can grow and if it’s for personal use or for sale. For example, in Illinois you can legally own just about an ounce, while in Colorado you can legally own up to eight ounces as long as it’s on your property and not out in public.
You really need to be aware of these individual rules if you plan on partaking in anything cannabis related while traveling between states. You should also know that it’s always illegal to drive while under the influence of marijuana, and we don’t recommend or support anyone who does that.
Although we’ve talked about the individual state laws and regulations involving cannabis it’s important to note that the federal policy in the United States has always been that cannabis is illegal. Under the Controlled Substances Act (CSA) their isn’t a distinction between medicinal and recreational cannabis and classifies it as Schedule I drug along with drugs like Cocaine… Which isn’t even close to the classification that the UK or New Zealand give it.
As any American knows, cannabis laws in this country are outrageous and is a huge problem involving the prison system, but that’s another issue for another time.
Punishments for breaking these federal regulations are often very strict. That being said, now that there are state regulations that are stating that cannabis is legal, it creates a gray area for enforcement. In 2013 the Department of Justice put out a guidance memo stating that enforcement of the federal cannabis regulations in “legal states” is not a priority. Which essentially means they won’t be actively fighting against the states decisions. This was actually redacted in 2018 by President Trump’s regime, but we haven’t seen too much push back in terms of the federal government going after legal states.
Laws and Regulations Involving Growing Cannabis and Cannabis Seeds in the United States:
Similar to general cannabis regulations, the regulations involving growing are different in each state. Cannabis seeds and growing cannabis is currently illegal in any state that cannabis is still illegal on a recreational level.
Even in states with legalized cannabis, the policies differ. For example in Washington D.C. you can grow up to six plants at once with only three of these plants being mature at a time for recreational purposes. While in Oregon you are only allowed to grow up to four cannabis plants for recreational purposes and you need to pay fees to ensure some sort of regulation. In all of these states there are also maximums on cannabis in your possession, so definitely be sure to be informed on the regulations and policies in your city.
